A judge at the Technology and Construction Court has ruled that CHG must pay Sydenhams £128,386.38 plus interest for work that the timber engineering firm carried out at a hotel in Bournemouth, including manufacturing timber frames, producing windows and undertaking internal joinery. Of that total, Sydenhams must pay CHG £35,000 for defects and liabilities that were cited in a counter claim.
During the dispute, CHG said that it was the main contractor, Rybarn Ltd, that was liable to pay for the work as part of a £500,000 contract.
However, Judge Peter Coulson QC ruled that Sydenhams had a direct contract with CHG and not Rybarn, which is now in liquidation, and that it was liable to pay for the work carried out.
