TRADA members were told to “put it in writing” at a recent seminar on how to manage a business in a recession.

Clarkslegal deputy managing partner David Rintoul stressed the importance of the written contract and of good record-keeping.

“Knowledge of the contract terms you have agreed to is absolutely essential,” said Mr Rintoul. “You may tender on your own terms and conditions but the main contractor will usually respond with theirs. If you renegotiate terms and conditions, keep full written records of amendments agreed.”

In his second presentation about cash flow and recovering monies due, Mr Rintoul stressed the need to “keep open and maintain constant communications with the main contractor” in the event of a dispute; to try to resolve that dispute; and to prevent it turning into a legal conflict.
