Under the agreement damages incurred by Weinig will be settled by Homag via a compensation payment.
The patent case stems from Weinig’s assertion that the Homag BMB 900 powerProfiler processing centre infringed its own DE 101 37 839 patent relating to the Weinig Conturex window production machine.
It filed a claim at a regional court in Mannheim, but Homag contested the case and wanted Weinig’s patent to be annulled. At a hearing in March, the court found in favour of Weinig.
Now both parties have released a joint statement in which they say they have resolved the dispute amicably and by mutual agreement.
“Homag recognises the rulings of the regional court of Mannheim and the Federal Patent Court and will not be lodging an appeal,” the statement said.
“The Weinig patent continues to stand in Germany and is recognised in its entirety by Homag. The damages incurred by Weinig shall be settled by Homag via a compensation agreement.”
The agreement terms will see all existing Homag BMB 900 powerProfiler processing centres installed at Homag customers released from any claims and they can continue to be used without restriction.
In addition, Homag is entitled to supply an agreed number of processing centres with the Weinig patent until the end of 2014 and to manufacture the machines until 2015 using the patent.
Both parties have agreed to keep the content of the settlement agreement, including the compensation, confidential.
